SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN TYPES OF LIABILITY. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Indemnification

The arbitration shall be conducted in English, and the arbitrator's decision shall be final and binding. The arbitrator shall have the authority to award the same individual remedies that a court could award. 11.3 Class Action Waiver

YOU AND PIZZA RANCH AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. NEITHER YOU NOR PIZZA RANCH MAY PARTICIPATE IN A CLASS ARBITRATION OR CLASS ACTION RELATED TO THE SERVICES OR THESE TERMS.

11.4 Small Claims Court

Notwithstanding the arbitration provision above, either party may bring an individual action in small claims court for disputes or claims within the scope of that court's jurisdiction, provided the matter remains in such court and does not seek relief on a class or representative basis.

11.5 Exceptions

Either party may seek emergency injunctive relief in a court of competent jurisdiction to prevent irreparable harm pending arbitration, without waiving the right to arbitrate the underlying claims.
